Use of College Name and Marks by Non-Compensated Faculty
Non-compensated faculty members are not permitted to use DUCOM's name and logos, seals, insignias, and marks (hereafter "marks") in connection with their private professional, clinical and patient care activities. Accordingly, the use of DUCOM marks on prescription pads, appointment cards, and patient handouts is not permitted.
Non-compensated faculty members may use DUCOM's name and marks in the following ways:
Stationery for academic purposes. Stationery with the College’s name and/or marks and the faculty member’s faculty title may be utilized only in connection with College business and the faculty member’s assigned College duties. Accordingly, College stationery may not be used for personal communications, including, but not limited to such things as Letters to the Editor, solicitations for charities, political endorsements or petitions, commercial endorsements or advertisements.
All stationery bearing the name and/or marks of the College must contain the following statement:
“The College of Medicine grants faculty appointments for teaching and research purposes only. The physician’s clinical practice is independent of Drexel University College of Medicine.”
All College of Medicine stationery must be ordered through Drexel Printing and Mailing Services.
Business cards. To be eligible for DUCOM business cards, the non-compensated faculty member must have an administrative title in addition to her/his academic appointment and specific approval from the Dean. Business cards are to be used for academic purposes only, never for patients.
Business cards bearing the name and/or marks of the College must contain the following statement:
"The College of Medicine grants faculty appointments for teaching and research purposes only. The physician's clinical practice is independent of Drexel University College of Medicine."
All College of Medicine business cards must be ordered through Drexel Printing and Mailing Services.
Lab coats. Faculty members may utilize their faculty title, academic department and an approved College insignia on their lab coats. The insignia template can be downloaded from the Affiliated Hospitals and Health Centers section of the brand identity manual.
Academic and scholarly publications. Non-compensated faculty are welcome to use DUCOM's name and/or marks in this medium.
SCOPE AND PURPOSE OF THESE GUIDELINES
A. These Guidelines apply to faculty members who are not employees of Drexel University
College of Medicine (“non-compensated faculty”).
B. Because non-compensated faculty conduct their clinical practices as separate and independent businesses, the College does not assume responsibility or liability for these activities. Although the College does not own, manage, operate or insure the clinical practices of its non-compensated faculty, the College is sometimes named as a defendant in lawsuits that arise solely from the activities of these private medical practices. This can occur when a patient or member of the public reasonably believes that the non-compensated faculty is an employee or agent of the College. Improper or inappropriate use of the non-compensated faculty member’s title or the College’s name, marks and logos, especially in connection with patient care activities, can result in the College being held liable on the basis of “ostensible agency” or “apparent agency.” The purpose of these Guidelines is to regulate use of faculty titles and the College’s name and marks so that outside parties, including patients and the general public, correctly understand the relationship and status of non-compensated faculty members with the College.
USE OF FACULTY AND ACADEMIC TITLES
A. The proper format for use of faculty title is: name, professorial rank, academic/administrative title (if any), department name, Drexel University College of Medicine.
B. A non-compensated faculty member may use his or her faculty title for identification for scholarly or educational purposes or in connection with the faculty member’s assigned College duties or on the faculty member’s resume or curriculum vitae.
C. A faculty member may not use his or her faculty title in communications with his or her private practice patients or when communicating with other healthcare professionals about private clinical or patient care activities.
D. The faculty title may not be used in connection with any political, community, or philanthropic activity or fundraising. (See also: Memorandum on Political Activities and Code of Conduct)
E. Use of faculty title in connection with media interactions is governed by the College’s News Media Relations Policy.
F. Use of a faculty title for any commercial purpose (such as endorsement of medical products or services) or in connection with the faculty member’s private professional, clinical or patient care activities or practice is not permitted. A faculty member may not use his or her faculty title or appointment for purposes of advertising or marketing any private professional or commercial activity or practice in newspapers, journals, television and radio, telephone yellow pages or other directories, or websites.
INTERPRETATIONS OF POLICY AND FUTURE AMENDMENTS
The Dean designates the Executive Director of Marketing & Communications as the College official responsible for administration, interpretation and enforcement of these Guidelines. The Dean may from time to time approve amendments to these Guidelines when in his/her sole judgment it is in the interest of the College to do so.
COMPLIANCE
Upon written request of the College, non-compensated faculty must promptly provide copies of all letterhead, business cards, informed consent forms, and any other documents or information that might be seen by patients. This is a requirement of the College’s insurance company. All existing usages must be brought into compliance with this policy by no later than three months after it becomes effective.
